Writ of Mandamus

If USCIS does not act on your case within a reasonable time, you may consider filing a federal lawsuit. This type of lawsuit is called a Writ of Mandamus.

Our law firm does not currently handle these lawsuits. However, in some cases, a Writ of Mandamus can be a powerful option when USCIS fails to respond — even after repeated requests from you, your congressperson, or the ombudsman.

While USCIS may ignore these other inquiries, they must comply with a federal judge’s order if the court compels them to act.
