Submitting Late Evidence in Immigration Court: What You Should Know

Immigration Court runs on strict deadlines, and missing one can put your entire case at risk. If you receive critical evidence after your deadline has passed, you can’t simply file it late and hope for the best — you’ll need to submit a motion requesting the court to accept the untimely evidence.

In that motion, you must explain exactly why the evidence couldn’t be obtained earlier. Judges won’t excuse carelessness, disorganization, or neglect. But they also understand that some delays are unavoidable — especially when evidence depends on third parties, foreign governments, or situations outside your control.

When filing, include:

  • The motion asking the court to accept the late filing

  • A clear, credible explanation for the delay

  • All the evidence you are trying to submit

If your reasoning is legitimate and properly documented, the judge may accept the late evidence. But remember: exceptions aren’t guaranteed. The safest strategy is always to meet your deadlines.

Summary

Late evidence requires a motion explaining the delay; judges may accept it if the reason is legitimate.
