Evidence for a Motion to Change Venue

When you move to a new address during immigration proceedings, you may need to file a Motion to Change Venue to transfer your case to the immigration court nearest your new residence.

What Evidence Can Support the Motion?

Each immigration judge may have different requirements.

  • Some judges accept only the EOIR-33 Change of Address Form as sufficient proof of your new address.

  • Others expect additional documentation confirming your residence, such as:

    • Bank statements showing your new address

    • Lease or rental agreements

    • Insurance cards

    • Tax documents or other official correspondence

To strengthen your motion, include at least one or two supporting documents in addition to the EOIR-33 form. This helps demonstrate that your move is genuine and that the new court has proper jurisdiction over your case.
