Helping an Asylum Seeker Obtain Work Authorization

Our client, who is currently awaiting a decision on their asylum case, was eager to obtain work authorization to support themselves while their case was being processed. According to USCIS regulations, asylum seekers are allowed to apply for work authorization 150 days after submitting their asylum application. However, we know that the day count can be paused for various reasons, which is why we always proceed with care.

In this particular case, we submitted our client’s asylum application 155 days ago, carefully waiting an extra 5 days beyond the required 150 to ensure there would be no errors or delays on the part of USCIS. Following this, we filed their work authorization application.

Typically, USCIS has one month to process these applications. While the Rosario Class Action allows us to request expedited processing if USCIS does not meet this deadline, it usually isn’t necessary.

We are thrilled to share that our client successfully received their work authorization and Social Security Number (SSN) without any complications. This victory means that our client can now legally work, support themselves financially, and begin building a brighter future. We’re overjoyed to witness this next step in their journey and look forward to helping them in the future.
