Change of Status Applications
A change of status allows you to move from one nonimmigrant category to another without leaving the United States — from visitor to student, from student to specialty worker, from dependent to principal. The rules are unforgiving: file late, or allow your current status to lapse, and the application can be denied while unlawful presence accrues.

B-1/B-2 Visitor to F-1 Student:
One of the most common changes, and one of the most closely scrutinized. USCIS examines whether you intended to study when you entered as a visitor and whether you have maintained status through the entire gap before your program start date. We prepare the bridge filings this often requires. -
F-1 to H-1B and Cap-Gap:
When an H-1B petition is filed while you are in valid F-1 or OPT status, cap-gap relief may extend your status and work authorization until the H-1B start date. We coordinate with your employer and your DSO so nothing falls through the cracks. -
Changing to H-1B, L-1, O-1, TN, or E-2:
Employment-based changes are requested by the petitioning employer on Form I-129. We prepare the underlying petition and the change of status request together, and advise employers on documentation and compliance. -
Form I-539 Filings for Visitors and Dependents:
Changes to and extensions of B-1/B-2, F-1, F-2, H-4, L-2, and other dependent categories are filed on Form I-539, with biometrics required for most applicants. We assemble the financial evidence, relationship documents, and the statement of intent that support the request. -
Extension of Stay:
If you only need more time in your current category, the extension must generally be filed before your Form I-94 expires. A timely filing usually allows you to remain lawfully in the United States while the application is pending. -
J-1 and the Two-Year Home Residency Requirement:
If you are subject to INA §212(e), you may be barred from changing status until the requirement is satisfied or waived. We determine whether the bar applies before anything is filed and, where appropriate, pursue the waiver. -
Reinstatement and Late Filings:
If your status has already lapsed, options may still exist — F-1 reinstatement, or a late filing supported by extraordinary circumstances beyond your control. These are discretionary and highly fact-specific, and they should be evaluated immediately. -
Travel While an Application Is Pending:
Departing the United States while a change of status application is pending is generally treated as abandonment of the request. We advise on travel, on consular processing as an alternative, and on what a pending application does and does not allow you to do.
